When a Claimant Couldn’t Speak for Herself

We had the privilege of reviewing a case for a woman involved in a motor vehicle accident. While she was not severely injured, she did suffer a concussion and neck pain that resolved within a month. Additionally, she had a wrist fracture that resulted in a painful carpal boss and a minor loss of function in that hand. What seemed like a straightforward case took an unexpected turn due to the client’s memory issues. She was concurrently suffering from a neurological disorder causing mental decline, which made her a poor historian. During her deposition, she struggled to remember what had happened. The insurance company attempted to exploit this weakness and threatened to let the case go to trial.
The attorney representing the woman called us, and we devised a plan to create an indisputable document based on medical record facts to speak on her behalf. Given her neurological disorder, she was unable to effectively advocate for herself. We meticulously crafted a custom document detailing each of her injuries, any prior history in the same area of injury, and the treatment course.
This comprehensive document was presented to the insurance counsel—who then called to settle the very next day.
